Well, mostly a victory at least, as that only applies to 38 of the images. The law still applies to images which could be considered too realistic. As was the case with the 39th image as the court noted; Quote from the final verdict, paragraph 26 (translated), concerning the 39th image

Who's to say someone hasn't done exactly this. Not like we'd hear anything about how it happened or it would be written off as a lie to save himself. At least in the US both the average citizen and government(like they'd care either way easy conviction) seem to be that smart when it comes to technology. Also nice to see common sense prevailing. Now i have a possible country to put above the US again...And yeah i set the bar pretty low and ironically the US up till now outta "first world" nations still made the most sense. Basically fi you look into the cases here you'll find that loli is OUTRIGHT legal BUT the OBSCENITY cause makes it illegal. Hell TWO laws that made fantasy illegal were struck down by the supreme court. One from 96 and another from 2003 i think...Then congress used obscenity as a roundabout way and hello defacto/pseudo ban. |
