The author would not have to risk being sghut down if instead of a mario look alike he would have made an anatomically realist looking human fat plumber, then nintendo would have no legal claim even if he reproduced the original game mechanics and scenarios.

Right, I don't know why I forgot about that. Definitely follows the stylized-yet-detailed look of the series.

It's part of creating a game: Before you actually start designing levels and such, you want to make sure that the game can actually function. In the case of a 3-D platformer, you'd create your protagonist and the physics, then put him or her (or it) in empty stages of varying sizes, shapes, and complexity to make sure that this character moves the way you'd want. Then you create other things, like collectibles (coins, in this case), enemies, obstacles, and whatnot to test if the player character will interact with them as intended.
Basically, you want to make sure all your gameplay elements work before you actually start making the gameplay.

Looking at his Patreon, he is striking out to be an indie developer, but that doesn't necessarily mean he's going to be making Mario; It could well just be a cool thing he did that he's using to pimp his Patreon.

I wonder if a C&D would be given out to something like this anyway, considering he is using the Super Mario name brand recognition to bring in interested individuals.
