I understand that in adherence to Japanese law artists and adult filmmakers have to censor the genitalia of the actors and/or characters.

So I wasn't surprised to see the erotic scenes of the visual game Popotan to blur out the naughty parts. And that's how it is with the eroges, the HCG's are censored.
But lately I've been casually reading some ero-doujins and the ones I've been reading are very lenient on censorship. Very benign censorship like simply drawing a small black bar to cover out a very slim portion of the hot spot. So why is it that HCGs from H-games or H-animes can't get away with lenient censorship like that?

PS: I've noticed in the localized version of Da Capo by Mangagamer the HCGs are in fact uncensored. I guess the localization means they don't have to listen to Japanese laws anymore I guess?

I'm guessing for the game, they can release it uncensored since its not intended for the Japanese audience and is for that particular region.

Not sure on doujins. Are they the fan made art? I would imagine its up to the artist, I suppose.

One major difference between doujins and hentai anime/visual novels who actually makes them. Hentai anime and visual novels generally are released by major commercial companies. These companies are much bigger targets for a prosecutor who would argue that a law is being violated, and with simply being a commercial company these companies are much less willing to take on legal risk. In order to minimize their risk, usually these companies will not do their own censorship, they will have specific companies to do the censoring for them so if there is a legal challenge they aren't the ones at risk, the actual company who censored it is, and these companies will not usually push the boundaries beyond what is known to be absolutely legal.

Doujins on the other hand are mainly done by small, non commercial groups, to be mainly released at conventions. These individuals are more willing to push the boundaries and they do the censoring themselves. It is rare though for them to be challenged about the legality because they are smaller targets and very well may be within what the law allows.


As to MangaGamer, it is the same with the other English VN company Jast USA, and most (if not nearly all) English H anime releases. When one is not selling to the Japanese, one is not bound by Japanese law.
