^The rule about living things is saying that a living thing can be seen in the picture -so long as it isn't recognizable as a character, like a mob chara or Vaisaga's example of a hand holding the item-, not that the living thing can be the main feature of the picture. The point of the minigame is to guess items or sceneries
Regardless, there's no way the pic you originally posted qualifies as a minigame picture, since it's very clearly a human character easily recognizable

So long as it appears in a watchable portion of an episode, it's fine.

"Living thing" in that case is more, say, a random monster or something. It's not an inanimate object, but it can't be defined as a character. I used the AIM Burst creature from Railgun as a mini-game once, and something like the BETA from Muv-Luv would also count.
New mini-game is Korori, Futaba's stuffed doll from Seiyu's Life.
