They can, but their low ground clearance causes trouble. But if it's street-legal, then it should have the power to do so.

Of course, this is a company that's freely using iconic Nintendo characters without permission and unleashing loud vehicles all over urban areas, so who knows?

That sounds like an incredibly gray area. Though I would've figured it'd still fall under infringement as their clients are using them for a profit-making operation, especially since they all fall into a particular theme. Then again, from that perspective, it'd be like encouraging the go-karters to all wear Tommy Hilfiger shirts with that flag-like logo on it. (One of them was dressed as Batman, however, and another was dressed as a banana.)
