Shouldn't Kon sue for that trademarked title?

No, he shouldn't. Just because they have the same name doesn't mean their copyrights overlap. One is a movie and one is a song, if Kon didn't cover all uses of the title (which I'm positive he or any of the other involved didn't) then the song is fine. Besides, it was based on a novel before it became a movie so if it's up to anyone it would be Yoshikazu Takeuchi and I doubt they really care.

Anyway, just wanted to point out that they aren't so much robots in Dragonaut as they're synthetic dragons with cockpits connected to their backs.

I just found the above so beautiful that I had to see it quoted somewhere. Very Happy

Emerje: He's a kind of rights-holder in the sense that he's the only one who can legally use that name in an anime.

But it's still not the title of this anime, it's the title of the song, that's a huge difference. It doesn't effect the copyright just because the show uses the song, that's just another set of licensing.
