A better question is:
How do they define "intended to be used"? Who and how decides that someone intended to use something to do something else (in this case copyright infringement)? Without mind reading there's no way to know for sure what a person intended to do, so this seems highly subjective and abusable.

Just another step towards a Police State.

You do anything they don't like, and you're going to find some people on your doorstep, there to take everything that could potentially store an MP3, ever. And all they'll need will be an ip address which they don't even have to prove belonged to you beforehand - that's what they're seizing all your stuff to determine.

I doubt there's many people in the developed world that haven't committed copyright infringement either knowingly or unknowingly at some point.

Of course, the various big content companies that were behind this legislation chose the timing of it very carefully, to be just prior to a major election. They did the same thing when they rammed through the last piece of ill-considered copyright legislation (DMCA). Almost no debate, very few people voting against it because of fears that the same big content that are pushing it will tear them apart in the media outlets. Which they own. Confused

As if the Companies don't have enough legal resources already at their disposal. Expect this law to be challenged.

Also, WHERE IS MY DAMN OLD SHOWS FROM THE PAST DAMN IT?!?!

Well, they removed the provisions that allowed the government to bring lawsuits and the provision that would increase penalties by separating the files of music CDs into "separate works." This is a very good thing. The government has no place sticking its nose in civil law cases.

This law is, otherwise, not going to affect anyone's music collection on their computer. I have never file shared a single song in my life, but my entire CD collection exists on my hard drive, for my own, legal, personal use. This law hasn't changed that.

A lawsuit would still have to prove intent to distribute. They would have to prove that you had used, or were planning to use, file sharing programs, etc. in order to infringe on the copyrights. Simply having copyright materials on your PC is not a crime. I look forward to seeing this law tested, actually. The copyright owners still need to file the suits and it doesn't really behoove them to sue innocent people and lose tons of money and bad publicity with a trial against anyone not violating copyright laws.

I want to think that the anime companies won't be going RIAA on the fansubbers located in the states, but I wouldn't be so sure :S

first if you want to support the people who will work to have this struck down go to http://www.eff.org/

second i really wonder how much more money would the big media companies have if they didn't higher lawyer armies, or spend millions on copy protection systems that get cracked within weeks.

Just like how Stardock cuts out copy protection on their games, if you make a quality product you don't need to worry about people downloading and not paying for it.

Cait, think is big media would love to see you get in hot water for not getting their pay twice or more for what your already got digital versions.

I really wish that the gov would focus protecting out american production sector, which has been taking hits since NAFTA, rather than the mega media corps which make money hand over hand every year.

Now if they pull you over for a traffic stop they can confiscate your MP3 player / iPod / Nintendo DS / PSP and claim it is a vessel used for copyright infringement, slap you with a felony, and put you away for 10 years.

Funny, Rolando_jose, very funny, but almost true. Anime catgrin + sweatdrop If "Mr. Change" is elected, make it official!! Anime cry Putting that aside, this piece of legislation is crap. I can see many people being prosecuted and winning these cases against the feds for a multitude of reasons, especially invasion of privacy. This type of legislation is just another way to censor media and restrict its distribution, kind of like the horrible "Fairness Doctrine" most of the 120th Circuit of the US Congress (who gave us this illogical bill) is sitting on. Guys, expect a lot of protests and raisin' cain (lots of angry outlashes) over this. If this reaches into the anime fanbase in this country, we'll have to definitely join in.

Like your own countries would never fall in line once it starts.

Once the ball gets rolling, it's hard to stop it.

Maybe not in your lifetime, but kiddies, it really is a brave new world every few decades. My mother-in-law's school had an outhouse. You can still find people in the states who remember when automobiles weren't everywhere.

When I was a child, portable music was a transistor radio. Lp's were the format. Computers were sci-fi plot devices more than anything most people thought about.

Who knows what we'll be seeing in 20 yrs?
So to sit there & say what's going on here isn't headed your way is naive. The idea one person can create something & a million people can obtain a copy without proper recompense is one that just begs to be challenged. Of course the parties creating those items are probably going to work together to see they get their due. The question is just how far it goes.

I see Bush is doing more damage before he gets kicked out. I hope this gets out to the teens before election day, and maybe it could sway some votes.

You can say that again. It's getting very tiresome, and reminds me how many children that don't know much are running around the fora. Though I really have no one to blame but myself; it is an anime site after all.
