As has been seen in Bankruptcy proceedings before, the Court picks the winner of any "auction" if there even is one.

This is a non issue; the courts love the HELL out of 4Kids.

I believe the matter here is that the court has yet to decide whether the rights would fetch a higher price at auction or not; it doesn't matter how much the court like 4Kids in that matter(nor does a breach of contract case - the licensors were in the wrong as determined by a disinterested judge).

4Kids is being smart. Just because they won the court case concerning the current deal with TV Tokyo-NAS-ADK, that doesn't mean they're going to get future deals. So sell off Yugi-Oh now when they can still get value from it.

it's not over without 4kids until merger just like DiC and Cookie Jar in 2008.
