Cool. I'm glad we finally have a solid decision on this. It will be interesting to see how the anime and manga industries will adjust to this new law - I'm guessing not very well, considering their track record of never wanting to change.

Stuff like One Piece and Baccano! are done. One Piece glorifies revolting against the government, and Baccano! has gratuitous violence. That could damage the youth and give them the wrong impression!

Normally not my style to settle with an outright attack, but I couldn't resist the furball comment. I'm frustrated with this and you happened to be the target of me blowing off some steam. I might have refrained alltogether if not for your seemingly unfounded criticism of josei. Generalizing it a "smut" seems like quite a reach.

I think they can still sell it if just slap an R-18 sticker on it
... but the direction the new ToLoveRu anime is going, might as well slap an R-18 sticker.
and as for Strike Witches, I think SW doesn't contain "unjustifiably glorify or exaggerate" certain sexual or pseudo sexual acts and the depicted acts are also "considered to be excessively disrupting of social order" such as rape. Also, don't forget the Japanese Agency for Cultural Affairs deemed Strike Witches as "wholesome family entertainment".

I think the most important fact that a lot of people are overlooking is this part:

I think what this could mean is that the regulators would have to take into consideration the creator's purpose of intent on their work. So if a work has some kind of "Fanservice" then it would be up to the regulators to decide if the creator is using it for comedic or plot purposes and not just blatantly putting it out there for no reason. So instead of just saying "This has such and such so let's designate it as harmful material", they would have to actually evaluate the entire situation first before marking anything as "Harmful".
Also, there are a lot of other questions to be asked too:
Who exactly is regulating this?
Is it the Publisher?
An existing committee that already regulates anime and manga? (If it is, then I doubt anything would really be enforced)
A committee that's going to be created by the government?
Who's going to determine who gets to be on this committee if it has to be created?
How far will the Anime and Manga companies push against this?
Does this effect works that are already available or new works only?
etc. etc. etc.
Really, the only thing that we can do is wait and see what happens next. There's 4-5 months before the regulations are in place, and I expect the anime and manga publishers to fight against this in what could probably be an ugly battle. This isn't the end of Anime or Manga, just another roadblock placed in front of it.

So do I. But I realize that it, and similar works, pushed the envelope and caused the government to (over)react.
I certainly support the industry (hell, I bought the Aniplex bd boxset) and their right to produce whatever they wish, but I also recognize that actions have consequences.

No according to my Japanese friends, stuff like One Piece and Baccano are ok. It is stuff like Queen's Blade and KissXSis that freak 'em out.

I can see "shady" business going on for some titles. Mainstream anime like One Piece will get a "pass" while fan service-like/whatever they find offensive will either get the axe or they will have to bribe hard. The vagueness of the bill can make this a possible scenario.

You do know that the implications here are in how vague the the bill is right? According to the bill Kara No Kyoukai movie three would be banned (remember the rape scene at the beginning? Yeah that means the box set could be in trouble down the line if they count already released titles) so it's not just something that pertains to annoying ecchi fanservice shows. Instead of being a douche about it you could take a moment and evaluate the implications more thoroughly.
EDIT: Btw, I bought the set as well, even though it was highway robbery x_x

The publishers will find some way to get around this. It may involve some awkward writing and drawing, but they will do it.

Emphasis for the bolded part. I'd also add shoujo with mix of 'ero' on that bolded part too.
sankaku ran an entry/article on that (dated Oct 30, 2008)
"Shoujo manga is actually some of the most explicit manga outside of actual ero-manga, vastly more so than shonen manga and seemingly considerably more so than most seinen manga.

From what I'm told, there will not be any outright bans of anything. People will just need IDs to purchase some of the things that they didn't before, and the content that is shown on TV may change.
I guess we will have to wait and see how the laws are applied.
