It's actually very interesting that Apple has stricter rules about parody than Android. Fair Use/Parody limitations can affect a lot of independent creators.

Had Kill the Plumber actually received approval, it probably wouldn't have been too long before Nintendo started filing lawsuits due to the game being way too similar to Super Mario Bros.

^ Relative to the person who made this game and Apple, Nintendo is indeed the third party, even if Mario is Nintendo's first party game. That's probably where your confusion came from.

But Android did give it approval, only Apple said no. That's why it's interesting. How will Nintendo react, if they react?

And yet Apple will still sell you a dozen different apps for downloading and reading scanlations. And Apple gets 30% of every sale.

No. It's third-party from Apple's perspective. Mario is first-party on Nintendo's consoles and such.

You're asking for logic from a company that just banned any and all Civil War games on the grounds they have the Confederate Flag. Apple's best understood as a beast that might approve your app if you follow its rules(and will easily come up with bullshit reasons not to if they don't like it).

You're making me feel gosh-darn old. spoiler[ok, fine, "Jumpman" isn't "Mario". Sure he's not...]

On the original topic, would the game be worth anything if it wasn't an obvious dig at Nintendo? If not, the author is really only making money off the trademark infringement. If so, just change some sprites around so it's not obviously sponging off someone else's work, and release the game that way. Solved. ("Flappy Bird" was on iOS with the totally-obvious Mario background art.)

Apple probably knows that this makes them susceptible to having Nintendo throwing the book at them, so they saved themselves the trouble. And they probably weren't impressed with the game anyway.

Yeah, I was wondering about why this game was rejected whereas Flappy Bird was not, even though that's blatantly using artwork that looks like Super Mario World.
