Ugh, why do people keep saying this kind of stuff? As I already mentioned it is not unconstitutional because it's privately owned space, therefore the owners of that space can accept or reject whatever they please when it comes to the usage of that space. The constitution protects free speech, but it also protects your rights in regards to property. Just as I can't walk up to your house and paint what I please on your garage door, companies are also not able to paste whatever image they please on PPTD property.
Again, I don't agree with their claim, but stating what they did is unconstitutional is flat out false. |
Actually, I believe that since it's a city department, it's a bit more complicated. The PPTD is not a private entity from what I can tell.
As I mentioned earlier, this reminds me of a case where the Chicago Transit Authority enacted an ordinance that banned all ads for M-rated games. They were sued by the ESA, who argued that the ordinance “restricts speech in a public forum that is otherwise open to all speakers without a compelling interest for doing so.”
The courts agreed, and the ESA succeeded in their lawsuit.
Now, this case is less clear-cut though, because there is no specific ordinance here. When you have a clear ban on M-rated games but allow ads for R-rated movies, it's easy to show that you're specifically targeting video games.
But in this case, the arguement is just that the PPTD is inconsistently applying its standards, which is much harder to prove.

Yet, Arizona has absolutely no problem showing orbit commercials that come very, very close to saying some pretty crude words and some of those words are spoken by minor's as well. |
I don't think you have actually watched those ads if you think they came close to saying "crude words".

How the hell can an art style be vulgar?
Anyway this is really asinine. There's nothing wrong with the ad at all. Just typical conservative BS since it obviously has to more with the miniskirt than the guns.

The ad is not crappy at all. I actually really like the design and style of the character. When I saw the picture in the video I actually got a craving for sushi... which is odd because I really don't eat sushi. The design of the character seems pretty upbeat, happy and fun. I get the impression that if I was to go to that restaurant, I would have fun.
The point is that the ad does it's job.
The only comment I have about the image itself is a question: Why is she holding guns? I don't find it violent or offensive... I'm just curious. Why is a sushi mascot holding two pistols? What do they have to do with sushi? I'm sort of confused...

But, but, but ... swords? This is Arizona we are talking about. I..I..I..Its not swords that you are encouraged to bring into the bar with you to brandish around after you get drunk, its guns.
Get real dude, swords are dangerous!!!. Plus, killing someone with a sword when its 107 in the shade is really draining.

I must say, I think of all the alternatives suggested for Suzi to be brandishing, swords are by far the best. That aside, the rejection of the advertisement on the grounds put forward by the PPTD are silly, irrespective of whether or not it is in fact a publicly-operated organization. At least, as had been pointed out, Stingray Sushi is getting its money's worth out of the media response.
On something of a tangent: Suzi's outfit and armaments reminds me of the girls from Highschool of the Dead. I have to wonder how much of a conflagration the ad would've triggered if it had depicted one of them in all of their very detailed, fanservicey glory.

No way on that. HotD girls carry swords, shotguns, bayonets so far not hand guns. Plus HotD girls have more assets.
That girl reminds me more of Revy without the cut off shorts and tattoo. Perhaps if he had done a more conservative ad for the public transportation he wouldn't be in this situation. Always best to do your research first.

There's nothing wrong with the ad in the first place. It's just people complaining for no good reason.

There is no "right" or "wrong" but "allowed" and "not allowed". He crossed a border that was not meant to be crossed and got burnt.
He needs to file it under "things not to do next time when I try to apply for public transportation ad placement" and move on.

He didn't cross anything. As has been said in this thread they are playing with double standards. The bigger issue is them refusing to pay back the money that was already paid for the ad.

Well, if you want to get technical about it, pornography can be considered an "art style" and to many it's considered vulgar. Depends on the way you view things, really.

Except for the fact that that isn't pornography. So if we went by your logic then there is nothing vulgar about it.
