That's where I'm confused as well. Under the NET Act in the US, this is a criminal offense.
Problem is whether you want to burn PR going after someone civilly (and to be fair, the costs Funi were asking to settle were pretty fair, IIRC) or burn the PR should someone be facing jail time.
OTOH, I think a lot of that flak would be taken by the govt, since it'd be a criminal matter at the Federal level, opposed to a civil trial.
