So they don't want to create pornography of this material? Define that term please. Example venus de milo and the statue of David have at one point was considered pornographic. But they are not now. A piece of artwork that is tastefully drawn isn't pornographic.

Research has shown that the majority of those classical Greek and Roman 'white' statues were actually painted so it must have been quite the garish show back in the day...

Like I said at one time it was considered pornographic but it isn't anymore. Artwork and it's interpertion varies from time to time and from culture to culture. But my question still stands. How do they define pornographic?

These guidelines have no mention of a contest. Pixiv is only mentioned as one place where fanart is posted. What you're referring to was mentioned in Crunchyroll's article as a possible reason for the timing: https://prtimes.jp/main/html/rd/p/000000122.000035885.html

Pixiv and Eva will have a "collaboration" starting in March 2021 and will run until June. The collaboration includes illustration contest(s).

Basically, to clarify: Ahead of an upcoming collaboration with pixiv, Khara has released fan art guidelines. The guidelines encompass the terms as a whole for fanart which will also include this contest. They are not limited to the contest.

Doesn't matter what the scope was meant to be, it already scared away one longtime artist.

AFAIK anyone who gets sued by Khara for drawing erotic doujinshi has a pretty good chance of arguing a parody defense.

AFAIK there's no parody exception in Japanese copyright law. Might apply for US artists though?...

AFAIK there's no parody exception in Japanese copyright law. Might apply for US artists though?...


There definitely is. Whether an erotic doujinshi would actually be covered under parody exception and whether imitating character designs in fan or commercial art can even legally be considered a copyright violation are both debatable, however.

No, in Japanese copyright law parody defense doesn't exist, in broader scope fair use exception doesn't exist. There are 'quotation rights', but it's proven in Japan Supreme Court those don't extend to parody;

WELL SHIT!

there goes the neighborhood! you'd think that studio would take nintendo's advice and QUIT WHILE THEIR AHEAD!?

the big N tried that with pkmn for so long, but ero circles like gambler club and artists like jun kousaka are still going strong cause nintendo learned the HARD WAY not to open up pandora's box since most of the popularity of certain series that is decades old come from comiket doujins!
