Im not sure if this topic belongs in Anime but if it doesnt anyones more then welcome to move it.I was wondering about the Eroge Visual novels released by Manga gamer that obviously have underage girls in them that feature sex scenes.But when i asked Manga Gamer on their Facebook page they said Hi this is one misconception about our games we assure you every girl is over the age of 18 then they said what a great question thank you for asking lol.I was just wondering isnt it illegal to feature underage girls naked and in sexual acts in games in the United States?And why does Manga Gamer deny something so obvious?

As long as it holds either artistic, political, or scientific value, it's legal.

You might want to look up the Miller Test for further information.

Hiro94, while it's true the law clearly states no person under the age of 18 can be depicted in scenes involving graphic sexual situations, or nudity of a lewd nature, there currently is no law that specifically designates a fictional character as a real person. So technically MangaGamer is not even required to supply a disclaimer that all characters are over 18. Basically it is up to their discretion which games they choose to release, and which are appropriate given current laws in the locale they are released in. They are not breaking any laws or even violating any specific moral code. This case just happens to aggravate your personal rationale for whether those girls are over 18 or not. Solution: don't play those games.

At first, I had to question that disclaimer as well, but then I remembered that Ecchi anime also features many underage girls naked and/or in sexually arousing situations, yet no one has ever tried to make a case against any of those shows, so why would VN's be much different? Wink

I'm pretty sure Past is incorrect. Fictional depictions (both in cartoon and text form) of underage characters can be and have been considered child porn in the United States. If they are not protected under the 1st amendment (which is what the Miller Test determines), the fact that there's no "real" person is no impediment to prosecution.

There's just no reason why MangaGamer should invite the trouble by acknowledging what the cultural context clearly establishes: That many of these characters are under 18.

Ecchi anime would not typically meet the Miller test for obscenity for completely different reasons: It doesn't actually depict sexual acts. So it's protected under the 1st amendment.

Thanks for the replys everyone i have nothing against visual novels at all actually.I was just confused about the law and everything as far as that goes.And im only 17 so i could care less if they had underage girls lol.

are you talking about loli or just the rule of tumb that most vn/eroge girls are underage in general?? Well i can let you know one thing it's how they look in animation not their age. Take up jastusa's loophole example lol.

Take rei or asuka from evangelion for example they have the bodies of 20 year old super model but in reality they are 14. The characters also act older than then look take same from yuno from future diary and Shion from higurashi. Now if the character is completely flat chested with no hips, curves or a huge a** "even Louise from znt has these" it falls into a huge grey area.

All i am going to say is this what is your moral choice or feelings on the issue?? Does it really bother that much they are under the age of 18 where in most countries the age of consent is 15/16 or do you have other legit reasons to where it really bothers you?? Listen it takes a lot to bother me in this day/age or even shock me anymore so this isn't a huge issue for me however if you don't like it then just play all ages versions.

I already said it doesnt bother me at all i was just really curious about the legality about it here in the United States thats all.And as for morals i dont care im 17 so it doesnt really bother me lol.

This belongs in the Novels forum, so I am moving the thread after posting this.

Claiming that "all models are 18 or older" when they clearly aren't is a long-standing ass-covering gimmick in VNs and ero games. One of the better-known Japanese ero games in the States features a youngest daughter who's very strongly implied to be in middle school (and has a more middle school physique) but is still technically listed as being 18. No one playing the game would actually believe that, though. Fudging by claiming that a character who's more probably 16 is actually 18 is practically standard procedure in those games.

Oh yeah I know which one you are talking that something, something family but yeah it was painfully obvious on that. I'm still surprised that slipped through the cracks but it's nothing again that shocks me.

Take kannon, air, little busters ex for example both are eroges from the source and well know the ages for the characters. I still however stick by my other claim it's how the character looks not their age as a rule of thumb for these games.

Just in case it's not clear from what Key said, the characters all being set at over 18 is how they're published in Japan, not something MangaGamer makes up for the English versions.

Keep in mind also that Mangagamer is not a US based company. They are based somewhere in Europe, though I cant remember which country and have no idea what the laws are regarding this kind of content is there.

But I remember when someone questioned about them about it with Koihime Musou, they insisted that all characters were over 18, and used a quote from RinRin from the game where she insisted that she was an adult. They obviously know that this is not the case, but it would be kind of hard to prove the age of fictitious characters.

He does have a point with everything before that, though: those are not character designs of 14 year olds(sixteen I could believe). Makes you wonder if they changed the age late in the game for whatever reason.

Hips, thighs, ass, love handles on a girl that young.. that's super model territory no matter how you spin it. Girls that age don't have bodies like that and if the do... welp I blame hormones.

On track here is an example of jastusa's selling tactics for their titles.
