So tracing of photos and other media as reference, homage and recrations in Japan is bad and illegal too?

This is at least the second time that this has happened with Pokemon, hopefully the TCG illustration contest has better luck.

As an artist, no one is really upset if you use real life references (especially if you took the photos yourself) for illustrations or find inspiration from other artists. And in general, if you trace something for use in a deliberate parody of the work you're tracing, then it's "fair use" in many countries. It's only a bad idea if you directly trace someone else's work or photos and pass them off as your own original work, which is what happened here. Even more garbage if you make a profit off the work.

When you're directly tracing/recreating other people's media to the point it's almost identical, and then passing it off as YOUR unique work then yes, that is bad and rather scummy. Doing it to make a profit is, and should be, illegal as well. Paying homage to something/someone is not the same as blatantly ripping off their work and passing that off as your own unique work. How that is debatable is beyond me.

I got Cotoh Tsumi‘s Akaban artbook last week and I didn‘t know about the tracing allegations until I read the articles here on ANN. I then watched some japanese videos on youtube and yeah… some of the artists artwork was clearly traced from other existing artwork such as photos while others were slightly modified from the original source with an unique spin on colors and additional details in the background. On the other hand, some illustrations clearly pay hommage to famous manga, movies and photographs (such as Mathilda from Leon, Bulma from Dragon Ball or Hikaru from KOR) that it‘s kind of obvious to me that many of Cotoh Tsumi‘s illustrations are not completely original creations. Furthermore, the artist‘s work is clearly Pop Art, a genre which deliberately uses and modifies pre-existing artwork, so I don‘t know how I should think about this scandal. The artist probably should have seeked consent from the original rights holders and should have made it more clear publicly beforehand that many of their illustrations have in fact been copies or at least modifications of pre-existing images.

A steady investigation by volunteers is still ongoing into allegations of plagiarism and money laundering by Cotoh Tsumi and his associates (who are mainly active in China).

1)Currently in Japan, there is an ongoing verification of plagiarism by volunteers regarding the plagiarism of Cotoh Tsumi.

2)The publisher of the book "Red Disc", Geijutsu Shinbunsha, is currently suspending shipments of the book due to suspected copyright and portrait rights violations.

3) Cotoh Tsumi is suspected of possessing child pornography because he had asked underage girls to send their photos.
(It's almost certain that Cotoh Tsumi has been misrepresenting his gender.)

He has deleted his twitter account where the evidence remains.

Tracing anything and then passing it off as your own work has never been OK in Japan... it's always a scandal when it's found out. It's not necessarily illegal (that depends on the copyright status of the assets traced) but if money is involved it usually results in some kind of punishment.
