while the idea of copyrighting food items, especially common ones, is kind of absurd the idea of copyrighting photographs of food isn't. after all, if you couldn't this would mean that a publication like a culinary magazine or a recipe book could use any photograph of food they wanted and not have to get permission or pay the photographer to use it. if the mangaka was copying photographs of food that's rather different from them just drawing food using several references without actually copying and/or their imagination as to what it should look like.

you would think that they would have learned by now.

I mean, if it was me, I would go out, buy a camera and just take the pictures myself of food / food items. Hire a chef to prep the meals to look good, take a picture and go from there. Then you at least own the pictures and jack can't be said about it.

I don't expect a mangaka to be able to draw anything and everything. There stories may require them to take on a challenge that they can't draw and I see no problem in this method AS LONG AS, it's not already copyrighted material but photo's that they have taken themselves for reference.

hell I'd be up front about it at least. "yeah, foods a bitch, I took a picture and traced it" *shrugs*

It was those specific photographs of the food were copyrighted, not the food itself. Either find out who the photographer is and make a deal with him/her, or take up your own camera and do it all by yourself.

Are you for serious?

It's a photograph OF food. It is not actual food.
