The root of the problem is very simple, Yu-Gi-Oh! TCG sales are way, way down. In the past year the the total sales for the brand (at least in the TCG part) are down about 73%. This has driven the price of the valuable singles up again so that the "hot" cards that you have to own in order to perform well at large scale events are around $250 each, so a top tier deck will cost you about $1200. Then the valuable cards are released as a common the very next set. This has created an artificial bubble in the secondary singles market making the game unplayable for kids. In Japan they don't have this problem. I believe Konami sees the writing on the wall and wanted to fix the problem before it got more out of hand. This court ruling now precludes that from happening. The smart thing for Konami to do now is to either sell the rights to the game ad hoc to UDE in the US and Europe, or simply disconinue the TCG until further notice.

So in Summation: Konami are stupid because they fail at translation and UDE are stupid because they reprint rares as commons?

More or less, yes. They are both going to fight about it and wreck the brand. On an up note for both UDE is doing well with WOW, and Konami is doing well with Blue Dragon, so they probably won't care in six months. Konami is distributing Blue Dragon themselves, the first time they have done this with a game.....hmmmm..... They start distributing a game, then decide to yank UDE's license..... Coincidence?
