Just as happened with Handley, there are many charges you might be arrested for (rightfully or not) which can lead directly to a subsequent search of your home and computer. Even an illegal search (such as a wrong address on a search warrant) can still stand-up legally if something illegal is found in that search. As long as the agents believe they are executing that warrant in good faith it is the law of the land that such a search is valid.

Which is why it's important in the Whorley case that anything that doesn't specifically apply to the flesh & blood child porn get removed or they have precedence to slam your little anime or manga collection. Roleplay with friends online? Via e-mail?

There's no contest of the child pornography law in the published opinion, so that's actually not really an issue.

The dissenting opinion in that ruling is really good.

On the Handley case it is important to remember that the word "child" here means any character that is or looks under 18.

Look at your anime and manga collection, even the non-erotic titles.

Any sex scenes with a character that looks under 18, is under 18 in the story or wears a school uniform and is therefore in high school?

If you have sexually explict dojinshi either in print or on your computer. Do you have any from shows with a significant number of underaged characters such as Evangelion, Sailor Moon, Chobits, Ranma or Revolutionary Girl Utena?

If so you could get in trouble if your stuff gets searched for any reason.

I urge you consider a membership or donation to the Comic Book Legal Defense Fund.

Exactly. Which is why I will only read doujins with characters 18 or older and spicy manga with adult characters. Not only would I want to otherwise, but I would never want to be arrested and have this on my personal records.

Because once something like this is on your records, no matter how hard you try to hide it, it will always be there for the rest of your life.

Although I wish there was a law that prohibited fanservice of any kind unless the character was 18. That would probably make it much easier for people who honestly follow the law.

That would be an incredibly vague and limiting law. Plus, it could be circumvented by authors changing characters ages arbitrarily, like H-titles that get translated to English, where young looking characters wearing clothes that look suspiciously like high-school uniforms are attending "college".

It's very flattering to see my response appear in the AnswerMan column! I just want to clarify what Brian said about my "notion that the series director "chooses" the opening song". My understanding is that most shows have a specific person who liaises with record companies and puts together deals to synergise music publishing with the anime (yes, I said "synergise" - deal with it). This liaison would talk with the production team to get an idea of what they think would be suitable for the OP/ED themes, and get a bunch of suitable songs together for the team to make the final pick. The director, having nominal charge over the anime's artistic direction, should have the biggest say. So that's what meant when I said the music choice "is (ultimately) made by the series director".

On the other hand, you do get instances where the music was a more personal choice, e.g. using Duran Duran's Girls on Film for Speed Grapher, or Juno Reactor's Guardian Angel for Texhnolyze. And I don't imagine the choice of SION for Niea_7's OP was much liked by the money men!
