Interestingly, in the Supreme Court hearings when drafting the PROTECT act, the judges specifically cited that Romeo and Juliet would have been logically classified as child porn, therefore the only reason why written works are excluded from the PROTECT act. It's basically the same with most "obscenity" laws. Anything that is only now considered 'art' (nevermind that some of the same materials were not a while back) can escape scrutiny.

I thought I would be relieved when it finally ended, but I feel physically ill now. At least he didn't get put on the sex offender registry. Hopefully that will set some sort of precedent for future cases like this as they pop up (and, oh, they will...).

The things he was looking at/purchasing were despicable, but I still don't understand how we can afford human rights to drawings. I know they convicted him of obscenity, but it still goes right back to them thinking they are protecting actual children (and animals...god that is just disgusting) by putting this guy away, but I think they are terribly wrong.

It's a shame that this guy plead guilty. A quick google search of this guy will keep him from ever holding employment ever again. I guess he should have thought of that first, but it still sucks.

It's a disgusting and dirty habit he got into, but seriously how COULD he have known he would have been arrested? He probably figured that if it's in Japan than it's ok here. There should be a warning of some sort when you purchase such things...

This is absolutely ridiculous. Does anyone with a better understanding of the law know if he can appeal even if he plead guilty? Light sentence or not, this man's life has been ruined over something that did not harm anyone else.

The funny thing is that it says he order some of these books from jlist, wonder if ANN or other sites will block their ads since they're apparently peddling kiddie porn.

The only harm that Manga did to a human was when the artist got hand cramps... jeez.

That protect act has to be amended. Seriously.

Well, I'm glad the court was very lenient with him, but seriously, who's interest does this really serve?

If he were really the type of child predator the law would make you think he was, then releasing him after six months isn't going to do diddly, but by the same token, if he isn't a child predator (and it seems that no one, not even the court believes he is), then what good have they done by making the man lose his livelihood and giving him a criminal record over drawings?

This B.S. needs to stop.

No he can't appeal, unless prosecutor lied to him during the plea bargain (like he said they wouldn't give him X years but they did) or something like that happened. Usually once you plead guilty thats about the end of things. You usually can't appeal anything if you admit to commiting a crime.

That's why obscenity laws should be repealed, because it's the only offense on the books where the actual fact that an offense even took place isn't established until a guilty verdict is rendered. Murder, rape, robbery, embezzlement, and the like have to actually be done before charges are even filed.

But is this drawing you have in your house "obscenity"? Well, we don't really know, but we're going to charge you with it anyway and leave it to the courts to decide whether or not an offense was committed in the first place. There is literally no way to protect yourself from obscenity charges because it's unclear whether or not what you possess is in fact obscenity.

Ugly, ugly attempts at social control. No basis on reason or justice whatsoever. What's it going to take to get it off the books?
