Correct. The 1939 MGM film is still very much copyrighted, and since it's obviously far more famous than the original 1899 novel, almost all derivative Oz works usually have, or want to have, some connection to it. The novel Wicked and it's stage adaptation are legally prequels to the novel, even though they take much inspiration from the MGM film (which is now owned by Warner). It had to be careful to avoid making overt references to the film, same with Oz the Great and Powerful, and the Wicked Witch of the West's appearance in Once Upon a Time. For instance, her skin color could not be the same shade of green that Margaret Hamilton's was in her appearance in the film. All Oz costumes are licensed from Warner, as well as anything relating to ruby slippers, since they were exclusive to the film. Most Oz works that don't want to deal with Warner have to walk an odd fine line between the copyrighted film and un-copyrighted novel.
