If he pleads out, there's no jury whatsoever. I believe the judge could throw it out, but judges have a lot less discretion at the federal level and there'd probably be a "THINK OF THE CARTOON CHILDRUNS!" uproar that'd cost him his job(and you thought judgeships were apolitical).

It's not just all about "obscene" cartoons, but to Japan as well.
In the town where I come from, there's still an intense hatred towards the Japanese from relatives who's fathers or grandfathers fought against them during World War 2. They even persecute against me just for speaking Japanese and telling them that I visited Japan. My girlfriend told me that "these types of people are nothing but racists & bigots who have never even looked at a manga in their entire lives". It's this kind of blind hatred that keeps manga out of the hands of Otakus in the certain parts of the United States. It's time for us to put a stop to the madness now!

I wonder if I visit to USA, I will arrest because of 'creating child pornography'? It must be strange.

No. As long as you don't bring any of it with you. But if you want to bring it to an event in the USA for whatever reason, it's always best to contact the department responsible for it and get permission. They can't prosecute you because of people who got your work to the USA without authorization, or even people who imported your manga. Imported things are the responsibility of importers, not exporters. You wouldn't even be considered the exporter, that's down to Amazon and other retailers. Licensees such as Funimation are also considered importers and held responsible for what they bring over.

I hope this leads to mass protests. I hope Anonymous "terrorises" lawmakers, judges and prosecutors with cartoon porn.

What's next? Mastubation illegal for under-18s?

This is why we need to abandon Puritanical standards for sex ASAP:

Quote:
A vocal segment of the population has serious concerns about the effect of pornography in society and challenges its public use and acceptance. This manuscript reviews the major issues associated with the availability of sexually explicit material.

It has been found everywhere scientifically investigated that as pornography has increased in availability, sex crimes have either decreased or not increased.

It is further been found that sexual erotica has not only wide spread personal acceptance and use but general tolerance for its availability to adults. This attitude is seen by both men and women and not only in urban communities but also in reputed conservative ones as well. Further this finding holds nationally in the United States and in widely different countries around the world.

Indeed, no country where this matter has been scientifically studied has yet been found to think pornography ought be restricted from adults. The only consistent finding is that adults prefer to have the material restricted from children’s production or use.

Rapists were more likely than non-rapists in the prison population to having been punished for looking at pornography while a youngster.

Rapists and child molesters use less pornography than a control group of “normal” males.

Sex offenders requesting treatment commonly disclose that pornography helps them contain their abnormal sexuality within imagination as a fantasy instead of their aggressively acting out in real life.
What does correlate highly with sex offense is a strict, repressive religious upbringing.

I hope jury nullification settles this once and for all.
I would actually side with that POV to some extent. But I would take the hardline anti modern tack instead of a reformist view.

And that is why an upbringing should be traditional rather than repressive. Sex should be acknowledged, and it should also be treated according to the traditional attitudes and morals of a society. Repression is arguably a function of giving sexual freedom to "adults" while denying it to the "adolescent". Maintaining a consistent and non hypocritical moral code even if it is a strict one will not lead to that problem. The Puritans themselves had a much healthier attitude towards sex than their Victorian successors in the late 19th century because they were not nearly as repressive. Their sexual horizons were simply narrow, and therefore there was little to repress.

I wish our horizons were as narrow today.

There was a recent issue earlier of an Yaoi Manga Hero-Heel. The manga had two gay males having intimate relationship with one another.

Should it be banned and the people who read it thrown in prison because some consider it "obscene" or objectionable?

What about graphic novels like Color of Earth?

http://www.amazon.com/The-Color-Earth-Dong-Hwa/dp/1596434589/ref=sr_1_1?ie=UTF8&qid=1350963130&sr=8-1&keywords=Color+of+Earth

Should this be banned and it's readers put in prison because the manwha is considered "obscene" by some simply for it's references of sexuality or it's fictional characters?

What about slap-stick comedies like "Heaven's Lost Property" or "Bludgeoning Angel Dokuro-chan" or romance comedies like "Love Hina" or "To Love Ru/To Love Ru Darkness". Should those titles be banned or censored because of their references of sexuality, nudity, and characters, and it's fans thrown in prison?

What has been happening to Manga recently is criminalization of not only of the creative realm of its artwork, but also of it's fans and possible current and future artist as well. Fiction has always been a form diverse of storytelling and artwork itself. Now Manga which is also part of fictional realm has been reduced to both a crime and censorship.

Just F.Y.I.: U.S. Federal judges are appointed for life.

True, but I'd imagine talk of impeachment would be thrown around heavily enough that he'd straighten up.

Indeed, very rare. The only real option is to wait and replace them with a different judge when they retire, or simply increase the number of justices/reduce the size of his jurisdiction.

I would really, REALLY like to see a fund dedicated to charging the prosecutors, legislators and judges in these cases with being accessories to child rape.

How many children could they save if they didn't toss their money away on "crimes" that so few people care about that it's readily available online? Hell, even an amateur artist could create a few pictures (or a few dozen) of cartoon porn that would be "obscene" under these definitions.
