Not really familiar with that relationship, are you? I'm kind of surprised that Funimation managed to stay afloat based on what I'd read about Navarre. Seemed to be one of the few times I saw a subsidary be punished for making a higher profit margin compared to the others. |

Funimation's market share and profitability took a huge tumble during its first few years of Navarre ownership. The company was even unprofitable at times, despite DBZ. They also poured quite a bit of capital into Funimationa and provided it with access to credit lines and equity it would have not had otherwise. There is a good chance that Funimation may not have survived the economic turmoil of the past several years, or may have ended up a much smaller company. It was also Navarre's massive distribution network, and the clout from its software products that gave Funi inroads into a lot of retailers. Without Navarre, Funi would have been a completely different, and likely much smaller, company. Look at how much of loss Funimation was sold for and the lawsuit that Navarre faced over the purchase. |

ARM no longer exists and hasn't for quite some time. There will be no forcing of them into any lawsuit. They probably couldn't issues subpoenas to the executives at JCI and Sojitz, as they are mostly foreigners over which has subpoena would have little or no power. If Sentai/ADV etc wanted to go after ARM, Sojitz, or the other investors, they would have to do so separately. The case is solely between ADV and Funimation. |

Without Navarres distribution and credit, Funimation may have never lasted long enough to need a life boat. We can never say for certain. |

So with the case being about mainly Funimation, a settlement between both sides is inevitible. |

fudge Funimation, no really fudge them. I'm sick of their badly-written soft-core porn. Honestly, I don't think Sentai is that much better, but at least they try to bring us more variety.

Where I'm starting to agree with you, they are putting out way too many "Boobies FTW!" shows. Those shows are what get us dubs/bd's for show like Princess Jellyfish, Shiki, etc. If they didn't put out the smut, they wouldn't have the money to do the more niche/obscure shows. So be thankful to the Boobies! Just hope this is over soon, and Sentai doesn't go under! I don't buy a lot of Sentai titles, but they are a licensing giant right now, we need those mass of titles to keep the anime industry where it's at right now! |

I asked my lawyer to look at this. He said that Sentai might come out of this okay depending on how ADV dissolved. If S23/Sentai/etc. are a completely separate corporate entity, they may come out of this fairly unscathed.
There is also an issue regarding the sale of Sojitz licenses to Funimation, and how all parties were informed of the terms. Sojitz/ARM seem to have operated like the much publicized Bain Capital. Unfortunately, though it is possible to sue foreign corporations, our laws allow companies like Sojitz (and Bain) to do what they do. It seemed to my lawyer that the way Sojitz transferred all these licenses to Funimation so soon after the demise of ADV, might give merit the ADV anti-trust claims. That being said, his conjecture is based solely on a few news articles and my memory of the events, and since the details are left to discovery, we won't see them. I remember being really happy when Funimation rescued all the unfinished Geneon licenses, and not-so-impressed with the acquisition of the Sojitz titles. I remember a lot of remarks about how Funimation was positioning themselves as a monopoly at that time, though my perception was that Sojitz bilked another company for some fast cash. I also thought the timing of this lawsuit was suspicious, coming so soon after the Sentai/s23 licensing spree. I remember wondering which boobie show Sentai nabbed that got Funimation's panties in a bunch? |

Funimation has quiet a bit of variety, and aside from that, even if they didn't you don't have to watch it, so why would you be "fudge" this and that over them releasing things you don't like? |

Very true. The additional distribution channels provided by Navarre definitely helped to take them to the next level. |
