I browse ebay for manga, and I usually come across licensed manga scan cd of series like One Piece, Ranma and Kenshin. I already know these are illegal and are also consider unauthorized copies since they're licensed. I contact a few people and warn them that what they're selling is illegal and some have taken it off ebay. But there's still tons of manga cd seller. I also notice a lot of anime hk seller have been banned recently for selling bootleg anime. That's a good start. I'm wondering why ebay doesn't do anything, like banning people who sell these "manga" cd. Your thoughts and opinion.

ebay isn't responsible for anything that people sell on there. They won't take action until they are contacted by a copyright holder, in which case their typical response is to ban the account of the user or remove all of the offending auctions. so, if you see auctions like that, it's best to e-mail the URLs to the companies in question. they'll contact ebay and get the user suspended. of course, it's trivial to make a new account.. so it's not very efficient. i wonder if JAILED would be more successful in the present day, now that there's a larger market for anime (and thus anime bootlegging)...? |

You are missing the point, ebay is in the business to make money. And they avoid a great deal of the responsibility to regulate/monitor what each user sells. Ebay will not dedicate the time and energy just to monitor the relatively few auctions of bootleg anime and manga scans that are illegal, in comparison to the enormous amount of other auctions.
As for what could deter these deadbeats, IMO a much better way is for ebay and local authorities to punish them with significant monetary fines. I’d say $10k for the first offense and considerable increases with possibility of Federal and International prosecution if the user is violating the copyright laws repeatedly. Neither is likely since people have written in to ebay and continue to report that most anime dvd auctions are bootlegs, ebay does nothing. Evilbay generates money on every single auction posted and sold, they are not going to lift a finger unless they legally are required to do so. |

Another thing you have to remember is that just because something looks fishy doesn't nessecarly mean that its illegal. There are alot of fanart/doujin that is burned on to CDs for distro.

Yes, but the CDs of manga found on ebay are rarely legit (much like the 'import' Japanese DVDs are rarely legit). It takes a very careful eye to find the legitimate products in the sea of counterfits. Tho, I guess sites like (adults only) getchu.com offer CDs for sale. I've seen other sites that offer direct downloads, too. I wonder if they do overseas shipping... |

I saw that a lot of the manga CD on ebay say yaoi and dojinshi in their titles, probably just to be misleading. I've reported quite a few manga CDs auctions to ebay but there are just too many of them.

I know you aren't here anymore, but does JAILED still exist? I think a big problem with it is that the US companies would have to invest a good chunk of money into it before it would have any real effect at all. |

Sure, it's easy to spot fanart and doujin, but when auction said "Berserk Vol. 1-25 Manga CD, Fully translated" and have page preview straight out of the manga, then it becomes obvious that it's manga scan. And when you see a guy sell about 500 of these cd, it kind of pissed you off. I can tell you right now, the majority of manga cd on ebay is not doujin or fanart. Most Common licensed manga cd off ebay: One Piece Berserk Naruto Love Hina Maison Ikkoku Ranma Well the Berserk manga had stop for a while, after serveral warning to the seller. Manga cd are rampart when i'm trying to search for real used GN. The best thing ebay could ever do is just ban the people. If they register again (assuming they used a new address), they'll probably not gonna do the same thing. Ebay have banned some large bootleg anime seller that had 2000 feedbacks, so who knows. |

I think that the banning of the bootleggers might have had something to do with ebay's new system. Now you can just imput the UPC# and it will make an auction up for you. If they've restricted dvd sales to those with UPC and ISBN only, then that could explain why the bootleggers cannot list them. They must have spent a lot of energy to get rid of them. I'm sure they wouldn't have done that if they though the bootleggers could easily re-register and re-list their items. Well, logically at least. Now to get rid of the bootleggers on amazon's shops.... |
