ESRB rated it on its own merits according to Hatsuu (a Xseed staff member), if you look at the whole package (an action game where you can choose a number of clothes options and there is a bit of lingering on damage which can be skipped aside from a bit of jiggle), it would be very odd lined up to games featuring torture, sex, gore and such... Not that it stopped Ace Attorney 5 getting an M rating.
