That's quite harsh, the paid upgrade economical system while understandable was already criticized but double dipping the full price plus some more won't be easily accepted especially when the Handheld Mode Boost exists. The only situation I can see myself double dipping would be for a Switch 2 SSBU with unrestricted lag input and improved netcode, heck i would even spend hundreds for that, it will be the 8th year for this game too this December.

SqEx are so freaking dumb when it comes to the Switch 2. They could easily just do upgrade packs for their Switch releases but insist on forcing people out of the vain hope of double dipping even though it's clear nobody is interested in that.

I don't really see the big deal. The whole upgrade thing is kind of new and not a standard with re-releases of older games. If you already own them for Switch 1 then do you really need the Switch 2 versions they're not exactly graphically intensive or probably need the upgraded hardware like Scarlet and Violet needed to be playable.

It’s not new at all. Paying a small fee to upgrade an old version of a game to a new console started with the WiiU, and became standard practice with the PS5. Telling consumers to pay full price for an upgrade patch to a game they already own? That’s new.

Are Switch 1 games backwards compatible with Switch 2 without the upgrade purchase? Or is that the whole point of the paid upgrade?

They're fully compatible outside of one or two exceptions (though that may no longer be the case. What you're paying for with an upgrade patch is generally just superior performance... BUT the Switch 2 can also run Switch 1 games with Switch 1 docked performance while in handheld mode, which means if the Switch 1 game can do 1080p docked, that same game can do 1080p handheld on the Switch 2.
Which reduces these patches to mostly just being for better fidelity and/or performance with the Switch 2 docked.
They're basically .ini tweaks that cost the developers very little to make or distribute (in most cases).
