Virginia Man Found Guilty of Downloading Child Porn

Anime Child Porn One of Several Factors

In March we reported on a man in Virginia who faced life in prison for, among other things, downloading anime-child pornography on a computer at the Virginia Employment Commission. The downloads occurred while the man was on probation for a previous conviction involving child pornography.

In total he was accused of 20 counts of receiving obscene materials, 20 counts of receiving obscene visual representations of sexual abuse of children, 14 counts of receiving child pornography and 20 counts of sending and receiving obscene e-mails describing sexual abuse of children. Besides the anime-child porn, he was also received digital photographs of children engaged in sexually explicit acts.

Yesterday that man was found guilty, by jury, of 74 counts of child pornography charges in U.S. District Court.

When he is sentenced on March 10, he faces a maximum sentence of 1,160 years in prison and a fine of US$18.5 million.

According to Times Dispatch the man was "the first person convicted under a 2003 federal statute that makes obscene cartoon drawings as well as photographs an illegal form of child pornography."

The 2003 Prosecutorial Remedies and Other Tools to End the Exploitation of Children Today act (PROTECT - Public Law 108-21), makes defines computer images that are indistinguishable from real children engaging in sexually explicit conduct as child pornography, while simple drawings which are easily distinguishable from real children are not considered child pornography.
